of EU Regulation in Telecommunications: Implications for Croatia

ABSTRACT
Telecommunications is a key infrastructure for economic
development and the basis for information and communication services.
Development in the sector is closely related to liberalization
and competition on the market. The WTO-agreement on Basic Telecommunications
- which is a commitment to abolish monopolies, to grant market
access for new entrant operators, to foster privatization and
to avoid unnecessary restrictions on services - can be seen as
a starting point, followed by a diverse range of legal provisions
on European Union basis.
Although Croatia is not joining the Union right now, and consequently
is not forced to take over the so called "Acquis Communautaire",
Croatian telecommunications law is nevertheless influenced by
the related European Union law.
As far as the current regulatory framework in telecommunications
is concerned, it is worth taking a look at the current law trying
to find out if it is "EU-compliant" and to what extend.
Besides giving a picture about the actual legal situation in Europe,
a closer look on the process of transforming EU's "new regulatory
framework" into national law should be given.
Taking over the new regulatory framework will be a big issue in
the upcoming years and part of the road ahead.

Margit Brandl, PH.D. teaches law and informatics
at the University of Graz and has published several scientific
papers concerning IT- and telecommunications law.
She works for Siemens as consultant in telecommunications
regulation.
She also worked for the Austrian Telecommunications Regulatory
Authority, being responsible for interconnection and market
regulation. |
